Terms of Service

Last updated: 16 October 2026

Pilot program notice: Riskify is currently made available as a limited pilot to approved organisations, free of charge, ahead of general availability. Features, availability, and these terms may change as the Service develops. Section 9 below explains what this means for fees and section 13 explains the limits on our liability during this stage.

These Terms of Service ("Terms") govern access to and use of Riskify (the "Service"), provided by Dryv Technology Pty Ltd ("Dryv Technology", "we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to these Terms on behalf of yourself and, if you are acting for an organisation, on behalf of that organisation ("you" or "your organisation"). If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle personal information and forms part of these Terms by reference.

1. About the Service

Riskify is an AI-assisted platform that helps organisations manage psychosocial risk, including risk registers, control measures, incident and concern reporting, anonymous surveys, consultation, worker briefings, evidence management, and related reporting. The Service uses artificial intelligence to assist with drafting, summarising, and triaging content, but final compliance decisions and records are always subject to human review and approval within your organisation.

2. Not legal, medical, psychological, or emergency advice

Riskify is not a law firm, medical provider, psychologist, or emergency service, and nothing in the Service constitutes legal, medical, psychological, or emergency advice. AI-generated content (including risk assessments, incident summaries, severity suggestions, and report drafts) reflects an automated best estimate based on the information provided, and may be incomplete, inaccurate, or unsuitable for your specific circumstances. It does not guarantee compliance with any work health and safety law or other legal obligation.

If a person describes an immediate safety risk, emergency, or risk of harm to themselves or others, they should be directed to contact emergency services (000 in Australia) or your organisation's emergency procedure immediately — the Service is not a substitute for that. You are responsible for exercising independent judgment, obtaining qualified legal or professional advice where appropriate, and for the final content of any compliance record, decision, or report produced using the Service.

3. Eligibility and accounts

The Service is intended for business and organisational use, not for personal or household use. You must be at least 18 years old to create an account. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. If you are an administrator within an organisation, you are responsible for the users you invite and the access levels you grant them.

4. Your organisation's responsibilities

As the organisation using Riskify to manage information about your own workers, you are responsible for:

  • the accuracy of information you or your users enter into the Service;
  • having a proper basis to collect and process your workers' personal information, and giving your workers any notice required under applicable privacy or workplace law before collecting their information through the Service (for example, before inviting them to a survey or recording an incident that names them);
  • configuring restricted visibility and anonymity settings appropriately for sensitive records, and for decisions your organisation makes about who within it can access particular records;
  • reviewing and approving AI-drafted content before treating it as a final compliance record; and
  • complying with applicable work health and safety, privacy, and other laws that apply to your organisation independently of your use of the Service.

5. Acceptable use

You must not, and must not permit others to:

  • use the Service for any unlawful purpose, or to store or transmit content you do not have the right to submit;
  • attempt to gain unauthorised access to the Service, other tenants' data, or our systems;
  • interfere with, disrupt, or place unreasonable load on the Service;
  • reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent applicable law gives you a non-excludable right to do so;
  • use the Service to build a competing product; or
  • misuse the AI features — for example, by submitting content intended to manipulate the AI into producing unlawful, harmful, or materially misleading output.

6. AI-generated content

Features described as AI-assisted (including the Copilot, guided risk register walkthrough, incident triage, and document extraction) use a third-party large language model to generate suggestions. AI output can be wrong, incomplete, or based on a misreading of the input, and is provided without warranty of accuracy. You must review AI-generated content before relying on it, and nothing produced by an AI feature is treated by the Service as final until a human user approves it.

7. Intellectual property

We (or our licensors) own all right, title, and interest in the Service, including its software, design, and underlying technology. These Terms grant you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business purposes, subject to these Terms.

As between you and us, your organisation retains ownership of the content and data it submits to the Service ("Customer Data"). You grant us a licence to host, process, and use Customer Data solely to provide, support, and improve the Service in accordance with these Terms and our Privacy Policy.

8. Fees

During the pilot program, Riskify is provided free of charge to approved organisations. We do not require payment details to participate in the pilot. If and when we introduce paid subscription plans, we will give you reasonable advance notice and the opportunity to agree to separate pricing and billing terms before any charge applies to your organisation. Nothing in these Terms obliges you to accept a future paid plan.

9. Confidentiality

Each party may receive non-public business, technical, or operational information of the other party in connection with the Service ("Confidential Information"). Each party agrees to use the other's Confidential Information only to perform its obligations or exercise its rights under these Terms, and not to disclose it to third parties except to the extent necessary to provide the Service (including to the subprocessors listed in our Privacy Policy), as required by law, or with the other party's consent.

10. Privacy and data protection

Our collection, use, and disclosure of personal information in connection with the Service is described in our Privacy Policy. By using the Service, you confirm that you have the necessary rights and, where applicable, have given any required notices to submit the personal information you enter into the Service.

11. Suspension and termination

You may stop using the Service, or ask us to close your organisation's account, at any time. We may suspend or terminate access to the Service if you breach these Terms, if we reasonably believe your use poses a security or legal risk, or, during the pilot program, if we discontinue or materially change the pilot. Where reasonably practicable, we will give you notice and an opportunity to export your Customer Data before an account is closed. Sections of these Terms that by their nature should survive termination (including intellectual property, confidentiality, disclaimers, limitation of liability, and governing law) will continue to apply.

12. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement, and without any warranty that the Service will be uninterrupted, error-free, or that it will achieve compliance with any particular law.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted, or modified. To the extent permitted by law, our liability for a failure to comply with a consumer guarantee that cannot be excluded is limited, at our option, to resupplying the Service or paying the cost of having the Service supplied again.

Subject to the above, to the maximum extent permitted by law: (a) neither party will be liable to the other for any indirect, special, consequential, or exemplary loss, including loss of profits, revenue, or data; and (b) our total aggregate liability arising out of or in connection with these Terms or the Service, however arising, will not exceed the total fees paid by you to us for the Service in the twelve (12) months before the event giving rise to the liability, or AUD $100 if no fees have been paid (as is currently the case during the pilot program).

13. Indemnity

You agree to indemnify and hold us harmless from and against any claims, losses, and liabilities arising from your breach of these Terms, your misuse of the Service, or Customer Data that you submit in breach of applicable law or a third party's rights, except to the extent caused by our own breach of these Terms or negligence.

14. Governing law

These Terms are governed by the laws of Queensland, Australia. Each party submits to the exclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals from those courts.

15. Changes to these Terms

We may update these Terms as the Service develops, particularly as we move from pilot to general availability. We will update the "Last updated" date above and, for material changes, take reasonable steps to notify customer administrators directly. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

16. General

  • These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service, and supersede any prior agreements on the subject, unless you have a separate signed agreement with us that expressly says otherwise.
  • If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.
  • You may not assign or transfer your rights under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of business assets.
  • A failure by either party to enforce a provision of these Terms is not a waiver of that provision.
